Privacy Policy
Laatst bijgewerkt:
This Privacy Policy explains what personal data we collect through homesinmarbella.com, why we collect it, how it is stored, and what rights you have under the EU General Data Protection Regulation (GDPR) and Spain's Organic Law 3/2018 on Data Protection (LOPDGDD).
1. Who is responsible for your data
The data controller is Teo Drabenche Chemi, NIF 78990825Q, with address at Avenida Santiago de Compostela, Nº2, Marbella, Málaga, Spain. You can contact the controller directly at teodrabenche@hotmail.com for any question regarding your personal data.
2. What data we collect and why
We only collect personal data that you voluntarily provide through the forms on this website: the contact form and the AI property valuation tool. Depending on the form, this may include your name, email address, phone number, the content of your message, your property interest (buying, selling, valuation, relocation) and, for the valuation tool, basic details about the property you describe (zone, size, number of bedrooms/bathrooms, condition and extras).
We use this information solely to respond to your enquiry, provide the property valuation you requested, and — where you have given consent — to follow up with relevant information about properties or services that may interest you. The legal basis for this processing is your consent, given at the moment you submit a form (Article 6.1.a GDPR).
3. Where your data is stored and who can access it
Form submissions are stored in a Supabase database (a managed PostgreSQL database service). The AI valuation tool also sends the property details you provide to OpenAI's API to generate an estimated valuation; OpenAI processes this data as a data processor and does not use it to train its models when accessed through the API.
We do not sell, rent or share your personal data with third parties for their own marketing purposes. Your data is only accessible to the site owner and to the technical service providers strictly necessary to operate the website (database hosting and AI processing, as described above), all of which are bound by appropriate data-processing agreements.
4. How long we keep your data
We retain your data only for as long as necessary to manage your enquiry and our subsequent relationship, or until you exercise your right to erasure, whichever happens first. We periodically review stored data and delete entries that are no longer needed.
5. Your rights
You have the right to access, rectify, erase, restrict, object to, and request portability of your personal data, as well as to withdraw your consent at any time without affecting the lawfulness of processing carried out before the withdrawal. To exercise any of these rights, please write to teodrabenche@hotmail.com, attaching a copy of an identifying document. You also have the right to lodge a complaint with the Spanish Data Protection Agency (Agencia Española de Protección de Datos, www.aepd.es) if you believe your data has not been processed correctly.
6. Cookies
This website uses only the technical cookies strictly necessary for it to function correctly (for example, to remember your selected language). For full details, see our Cookies Policy.
7. Changes to this policy
We may update this Privacy Policy from time to time to reflect changes in our practices or for legal, technical or commercial reasons. The "last updated" date at the top of this page indicates when it was last revised.
